NEW DELHI: Central Election Commission has given an affidavit in the Delhi High Court that it cannot interfere with the naming of the alliance of opposition parties as 'INDIA'. According to the affidavit, the commission has no power to interfere in political alliances under the Representation of the People Act, 1951. The Commission's affidavit cited the Kerala High Court judgment that political alliances are not legal entities and the Election Commission has no legal provisions to regulate their functioning.
The Indian National Development Inclusive Alliance (India) was formed by 26 opposition parties in the country in view of the 2024 elections. Girish Bharadwaj, a social activist, was the one who approached the court against this. The court heard the case in August and issued notices to 26 opposition parties. The court had also sought the response of the central government and the Election Commission in the case.
