THIRUVANANTHAPURAM: The Ministry of Home Affairs sought an explanation from the Governor on the seven bills sent for consideration by the President.

It is important to clarify whether the subject matter of the Bills is in the State List or the Concurrent List where both the Center and the States have the power to legislate.

The Governor had handed over the bills to the Union Home Secretary. The Ministry of Home Affairs submits it to the President for consideration after a thorough examination.

These were sent to the President before the Supreme Court considered the case filed by the government questioning the non-decision on the bills. The Governor exercised the power under Article 200 of the Constitution.

Raj Bhavan sources said that the requested information has been handed over. Five bills related to universities were handed over. Universities are included in the state list under the Seventh Schedule of the Constitution. However, there are higher and technical educational institutes in the concurrent list. Therefore, the position of the Governor is that there is no mistake in considering by the President. Clarification was also sought in the Lokayukta bill, which amended the section that would disqualify people's representatives from holding office if corruption is proven. The governor's position is that even though justice is a state matter, the Lokayukta Act was passed after obtaining the approval of the President, and the provisions of the bill are liable to be misused, and hence the President should examine it. The government is of the view that all the bills are amendments to laws and are the authority of the state.

In the past, bills recommended by the Legislative Assembly or the Law Secretary were sent to the President. This time it was sent to Delhi without a recommendation
