NEW DELHI: In the newly added sections to the Bharatiya Nyaya Sanhita there are provisions for punishment up to the gallows for terrorism mob lynching offences. Provisions related to terrorism are similar to UAPA.

Any threat or attack to the sovereignty, security, integrity and economic security of the country will be considered as terrorism. The trial will be done in sessions court. If five or more people kill someone based on their caste, language or creed, it will be considered mob lynching.

The offence of sedition which the Supreme Court had criticized was dropped and instead acts against the sovereignty, unity and integrity of the country were criminalized. Murder was under Section 302 in IPC but is under Section 103 in the new bill.

  1. Homosexuality is not a criminal offence
  2. Punishment for crimes against women was maintained
  3. If girls under 12 years of age are sexually assaulted, imprisonment will be till death or at least 20 years.
  4. Marital rape not criminalized
  5. Solitary confinement maintained
  6. Social service as punishment if one causes a disturbance in a public place while intoxicated
  7. Jail term up to 7 years for leaking question paper

If children commit crimes

There will be no case if children under seven years of age commit the crime. Exemption for children up to 12 years who do not understand the consequences of the crime.
