MUMBAI: Bombay High Court takes a different view in the POCSO case with the statement 'Sexual intercourse took place out of love, not out of lust'. The court clarified that since the accused and victim were in love, it could not be seen as sexual assault. The Nagpur Bench of the Bombay High Court pointed this out while granting bail to a 26-year-old man in a case of molesting a 13-year-old girl. The verdict was delivered by Justice Urmila Joshi Phalke.

The 13-year-old has given a statement to the police that she voluntarily left the house and lived with the accused Nitin Dhaberao. The court pointed out that the accused is a 26-year-old youth. The intimacy between two young people is what led to sexual intercourse. The court granted bail to the accused and made it clear that the victim was not forced to have sex outside of lust.

In August 2020, the father filed a complaint with the police saying that the girl was missing. The child was found by the police during the subsequent investigation. Later, the 13-year-old girl gave a statement that she voluntarily left with the accused. The girl told the police that Nitin had promised to marry her and that's why she took money and gold from the house.
