THIRUVANANTHAPURAM: Buildings not complying with the three-meter distance from notified roads can also be regularized now. This is after the government brought into effect the amendment of Kerala Municipality (Regularisation Of Unauthorised Construction) rules, 2023 and Kerala Panchayath Building (Regularisation Of Unauthorised Construction) rules 2023. Unauthorised buildings whose construction was started or completed before 7th November 2019 can be regularized. In previous years, houses up to 60 square meters were exempted from regularization application fees. This exemption has been extended to 100 sq m (1000 sq ft).

Along with this, the application fee of the municipality and panchayat for regularization has also been unified. The application fee for the regularization of houses and other buildings has also been reduced. Regularization is possible for buildings other than those that are contrary to approved urban development plans, do not comply with safety norms, violate the Paddy Field Wetland Act, etc. Different types of violations attract different rates of fines.

The government intervened after noticing that many buildings that had violated the rules could not be regularized due to various reasons. This will help solve the problems of building owners and increase the income of local bodies. - M.B. Rajesh, LSG Minister

How to apply

  1. Applications in the prescribed form should be submitted to the Local Body Secretary along with the plan of the building and supporting documents.
  2. An application fee at the prescribed rate shall also be collected as per the violation.
  3. The applications will be scrutinized by the District Level Regularization Committee and a decision will be taken.
  4. Those aggrieved by the decision of the District Regularization Committee can approach the State Appellate Committee.
  5. Those aggrieved by the decision of the State Appellate Committee may appeal to the appellate authority, the Principal Secretary.
