KOCHI: Justice Kemal Pasha decried conspiracy in the death of Siddharth, who was found hanging in the college lavatory at Pookode University. Kemal Pasha also favoured a CBI investigation to unearth the mystery behind the death. Kemal Pasha seconding a CBI investigation strengthens the demand of the family and the opposition parties that have been advocating for a CBI investigation since the time they suspected conspiracy in the death.
Kemal Pasha:
Only CBI can solve this Gordian knot. It is impossible for a person who suffered brutal torture for three days and is famished to commit suicide by hanging. The SHO who initially investigated did not take the incident seriously. The politics played behind the curtains is hindering the police investigation.
The presence of the CPM district secretary in the DYSP office and the magistrate’s house is not any serious matter that could have influenced the investigation.
The brutal torture that Siddharth suffered furtively has no direct evidence. As there is a possibility of changing the statement under influence and threats, the secret statement had to be recorded under Section 164 of the IPC before the Magistrate. Those who threatened the eyewitnesses should have been identified and charged under Section 201 of the IPC.
The post-mortem report states that he was beaten to such an extent that it was impossible for him to even think about hanging. Almost every inch of his body had an injury mark. There is a 15 cm bruise on the right side of the stomach. Internal organs are fatally injured. The police did not take the bruises, including the large intestine, seriously. Police do not have any idea about how the body was placed while it was found hanging. They did not try to find out important things like whether it was in a completely hanging position, or feet touching the floor, or whether in a recumbent position.
If it was hanged, the object used to strangle the neck could not be found and produced in court. It is also unclear whether forensic experts have reached the spot and examined these.
Kemal Pasha also harboured suspicion about the Dean's role in the murder saying it was unusual for them to take the body to the hospital even after the death was confirmed.
