NEW DELHI: Pressure on the Election Commission to come up with guidelines against measures such as the arrest of Delhi Chief Minister Arvind Kejriwal in a black money case in the liquor policy case. The complaint of the leaders of 'INDIA' is that the opposition parties are being denied equal opportunity in the elections.
In a petition given the other day to the commission, the leaders of 'INDIA' had asked why the Election Commission, which transfers the Director General of Police and senior officers in Bengal and other places, does not prevent the misuse of investigative agencies. They also demanded that the proceedings against Kejriwal be postponed till after the elections.
After Kejriwal's arrest, the CBI raided Trinamool Congress candidate Mahua Moitra's residence and office in Bengal. There are rumors that the ED is moving to implicate Aam Aadmi Party leader and Punjab Chief Minister Bhagwant Singh Mann in the liquor case along with Kejriwal. Opposition leaders alleged that a raid could take place at any time. Congress had alleged that due to the income tax action in the name of tax arrears which are years old, they can't spend money for campaigns etc.
It is required that investigation and raid proceedings should be conducted with the knowledge of the Election Commission as the code of conduct is in place. Sanction may be granted i the complaint is serious. It is also argued that the Election Commission cannot interfere in criminal cases. A criminal charge has been filed against Kejriwal. The central government and the BJP argue that the court's release of Kejriwal into ED custody is proof that the ED action has legal backing. It is indicated that the Election Commission will issue guidelines soon after considering the facts.
