THIRUVANANTHAPURAM: The government is likely to cancel the order appointing labor department secretary Dr K Vasuki for cooperation with foreign countries, violating the rule that states cannot interact with foreign countries without the permission of the central government. Experts point out that the appointment is constitutionally flawed.

The code of conduct states that IAS officers should not interact directly with foreign embassies, consulates and their staff. The Raj Bhavan clarified that it will ask for a review of the order if a complaint is received.

Vasuki's responsibility is to make cooperation agreements with foreign representatives arriving in Kerala in the fields of commerce, industry, education and employment and take further steps through the coordination of departments. States cannot sign agreements or treaties with foreign countries or agencies without central approval. The State Government shall have no dealings with the offices or representatives of foreign countries on cases beyond temporary issues. The permission of the Ministry of Foreign Affairs is also required to receive financial assistance.

The Cell for Foreign Coordination was formed on the instructions of the Chief Minister. The Centre has authority over 97 subjects including foreign affairs, defence, international trade, commerce and banking. States cannot interfere in this.

BJP state president K. Surendran said the order is unconstitutional. "Foreign affairs are under the jurisdiction of the Centre. The move to interfere in it is ill-advised. Kerala is not an independent state. It is a violation of federal principles. The appointment will destroy the integrity and unity of the country."
