KOCHI: The Kerala High Court harshly criticized after rejecting the anticipatory bail plea of actor Siddique in the sexual harassment complaint of the actress. The court said the complaint of the actress is serious and there is prima facie evidence of the actor’s involvement in the case. The actor’s anticipatory bail plea was considered by a bench headed by Justice C S Dias. The court criticized the remarks made by Siddique saying that the complainant has no credibility and is one who levels allegations against many others.
The court said that the argument that the complainant lacked credibility because she was a victim of sexual assault was unnecessary. The survival of the complainant should be considered. Siddique constantly attacked the actress who filed the complaint. The court also observed that this was part of an attempt to silence the complainant.
The court accepted prosecution's argument that as the petitioner was a person of great influence, granting bail would affect the case and it was necessary to take Siddique into custody and he should be interrogated. He should undergo a potency test and should be taken into custody for this.
The high court criticized not only the actor but also the state government. The court said that despite the Hema committee's report being submitted in 2019, the government kept silent and hoarded it for five years and the report came out after the intervention of the court.
