THRISSUR: The Consumer Disputes Redressal Commission has ordered to pay a compensation of Rs 16,80,367 to KA Shameer (45), a native of Kuranchery in Minalur, who became a chronic patient after undergoing a urinary stone surgery. The amount has to be paid jointly by the doctor and the hospital.
The verdict was pronounced by a commission with T Babu as president and Sreeja S and Rammohan R as members.
Shameer approached Dr AC Velayudhan of Aswini Hospital in Thrissur for the surgery. Dr Velayudhan had informed that Shameer was admitted to the hospital on June 19, 2014, on the advice of his doctor and his bladder stone was removed. However, Shameer started bleeding profusely through his urine and had severe pain. He underwent further treatment at Jubilee Hospital and Government Medical Colleges on the instructions of Aswini Hospital authorities, but the pain did not go away. Currently, Shameer is undergoing treatment at Sree Chitra Medical College, Thiruvananthapuram.
Shameer says that the doctors informed him that he would be in pain for the rest of his life as the neck of the urinary bladder had been damaged due to a surgical error and that he would have to undergo further treatment till his death. In the complaint, it was alleged that Shameer's marriage had collapsed and his wife left him. Shameer had produced 40 documents before the commission proving the medical error. Advocate KD Babu appeared for the complainant.
"There was no surgical error. This is mentioned in the medical board report. It is learnt that the patient has health issues."- Dr Velayudhan.
"Expert doctors have given statements that there was a surgical error. The doctors at the hospitals where the follow-up surgery was conducted were questioned." - Adv. K.D. Babu
