NEW DELHI: The Supreme Court will consider the plea related to the release of Malayali nurse Nimisha Priya jailed in Yemen, after eight weeks. The court directed to consider the plea if any emergency situation arises. Advocate Subhash Chandran, who appeared for Nimisha Priya, had informed the court about postponing the death penalty. That is when the court asked to inform if there is an emergency. The plea sought the intervention of the central government for her release.

The Centre had earlier rejected the application of the action council to allow them to go to Yemen to try for her release. The ministry of external affairs had informed that permission to travel could not be granted due to security concerns. The plea filed by the Save Nimisha Priya Action Council came before a bench of Justices Vikram Nath and Sandeep Mehta.


Nimisha Priya is in the jail in the Yemeni capital Sanaa in a murder case. She was awarded death penalty for killing Yemeni citizen Talal Abdul Mahdi in July 2017. Sanaa, the capital of Yemen, which is in the midst of a civil war, is under the control of Houthi rebels. The Indian embassy is in neighboring Djibouti. Nimisha Priya went to Yemen as a nurse in 2012 after marrying Tommy of Thodupuzha. After meeting Talal Abdul Mahdi, the two decided to start a clinic as partners. Transferred all her savings. Nimisha Priya, who reached her hometown with her family to find more money, returned alone.


Talal had made others believe that Nimisha Priya was his wife. He concocted a fake marriage certificate. He also performed the marriage according to religious rituals by threatening her. He stole her passport and sold her gold. He beat her brutally for filing a complaint. Her statement is that Mahdi died when she defended herself to save her life.


Meantime, Talal's brother Abdul Fattah Mehdi has come forward with the demand to set a new date for her execution. Abdul Fattah Mehdi revealed that he met the Attorney General to request him for a new date to execute Nimisha Priya. He informed this via a Facebook post. He also mentioned in the post that he is rejecting all attempts for mediation talks.
