Charges and sentences in actress assault case

KOCHI: The court in the actress assault case stated that gang rape, abduction, and conspiracy charges apply uniformly to all the accused. As a result, each of them has been sentenced to 20 years of rigorous imprisonment. Only Pulsar Suni faces the additional charges of recording the assault and unlawfully confining the survivor.

1. Pulsar Suni

Gang rape – IPC 376D

Sentence: 20 years rigorous imprisonment, Rs 50,000 fine (one additional year if unpaid)

Criminal conspiracy – IPC 120B

Sentence: 20 years rigorous imprisonment, Rs 50,000 fine (one additional year if unpaid)

Abduction – IPC 366

Sentence: 10 years rigorous imprisonment, Rs 25,000 fine (six months additional if unpaid)

Circulating nude visuals – IT Act 67A

Sentence: 5 years imprisonment, Rs 1 lakh fine (six months additional if unpaid)

Recording visuals – IT Act 66E

Sentence: 3 years imprisonment, Rs 1 lakh fine (six months additional if unpaid)

Wrongful confinement – IPC 342: 1 year imprisonment

Use of force – IPC 356: 1 year imprisonment

Outraging modesty – IPC 354, 354B: (No separate sentence)

2. Martin

Gang rape – IPC 376D

Sentence: 20 years rigorous imprisonment, Rs 50,000 fine (one additional year if unpaid)

Criminal conspiracy – IPC 120B

Sentence: 20 years rigorous imprisonment, Rs 50,000 fine (one additional year if unpaid)

Abduction – IPC 366

Sentence: 10 years rigorous imprisonment, Rs 25,000 fine (six months additional if unpaid)

Destroying evidence – IPC 201

Sentence: 3 years imprisonment, Rs 25,000 fine (six months additional if unpaid)

Abetment – IPC 109: (No separate sentence)

3. Manikandan, 4. Vijeesh, 5. Salim, 6. Pradeep

All four received the same sentences:

Gang rape – IPC 376D

Sentence: 20 years rigorous imprisonment, Rs 50,000 fine (one additional year if unpaid)

Criminal conspiracy – IPC 120B

Sentence: 20 years rigorous imprisonment, Rs 50,000 fine (one additional year if unpaid)

Abduction – IPC 366

Sentence: 10 years rigorous imprisonment, Rs 25,000 fine (six months additional if unpaid)

Abetment – IPC 109: (No separate sentence)

The assault and filming took place on February 17, 2017, during the actress’s journey from Thrissur to Kochi. Actor Dileep had spent 85 days in jail as a remand prisoner in connection with the case.
