NEW DELHI: The Supreme Court has ruled that secretly recording spouse' phone conversation can be considered as evidence in divorce cases. The new ruling of the Supreme Court has set aside the order of the Punjab and Haryana High Court that such evidence cannot be admissible. The Supreme Court also clarified that this is not a violation of fundamental rights. The important order was issued by a bench of Justices B V Nagaratna and Satish Chandra Sharma.
The Punjab and Haryana High Court had ruled that secretly recording a wife's phone conversation without her knowledge is a violation of her privacy and therefore it is not admissible as evidence in the family court. The Supreme Court said that evidence cannot be rejected on the grounds of violation of fundamental rights. This ruling has put an end to the confusion that existed regarding the collection of evidence in divorce cases.
