NEW DELHI: The Supreme Court on Saturday held that Lokayukta has no power to correct revenue documents and to order payment of tax. A bench of Justices Vikram Nath and Rajesh Bindal issued the order, dismissing the Deputy Lokayukta's order directing the Tehsildar to correct a mistake in the revenue documents of a property in Varkala. The Lokayukta had also directed to collect tax from the complainant. The High Court had rejected the appeal of the Additional Tehsildar against this. Following this, the Additional Tehsildar questioned this and moved the Supreme Court.
The Supreme Court found that the order for correction of revenue documents and collection of tax does not fall within the jurisdiction of the Upalokayukta. As per Section 12(1) of the Lokayukta Act, 1999, the Lokayukta has no power to issue directions. It can only submit recommendations to the authorities.
