Controversial advocate should withdraw from his leadership position

Occasions of a judge withdrawing the plea to consider a case revealing that there was an attempt to influence them is rare, but it has happened. But such incidences have only helped to increase the credibility of the judiciary. Judiciary is the last hope of a citizen in a democracy. People trust the judiciary. They believe that the judiciary will not be a puppet to influence and money. Apart from rare cases, the foundation of the Indian judiciary is solid. But people do not have such an opinion about the advocates in general. The drop in quality that has happened in all professions has happened there as well. At the same time, many advocates are skilled, knowledgeable, and committed to their job. There are advocates who lost their ranks because of involvement with criminal crimes. But none of them were in positions of power in the advocate's organization. The fact that Saiby Jose, accused of collecting kickbacks from clients in the cinema field allegedly to bribe judges for getting favorable orders, is the president of the advocates association is a matter of shame to the entire lawyer community.

Other advocate organizations have raised the demand that Saiby should be removed from the position. The accusation that this advocate took money from clients on the pretext that it is to bribe 3 judges was made by some fellow advocates themselves. It was the full court of the high court that demanded an investigation. In the investigation conducted by the vigilance wing of the high court, the conclusion that the accusation may be true has been reached. Crime branch investigation is in progress now. The investigation report regarding the same will be handed over to the DGP soon. One of the film producers who gave money was questioned earlier. In the case registered against the film producer by Ernakulam South police, an amount of 25 lakhs from him and 50 from another person was received as the accused crime against Saiby. The accusation is serious since the judges' names have also been dragged into it. The advocate claims that what he accepted was just a fee. Only after completing the investigation, the truth about this will be revealed. But till the investigation is over this advocate had to remove himself from the leadership position which has not happened so far. So the association should take the initiative to remove him from the position during this period. The Bar Council should take disciplinary action against him as well.

The public expects actions that would make sure that such acts that point fingers at the judiciary will not be repeated in society. The high court vigilance registrar has recommended that action will be taken against the advocate according to the advocates act. Hence model punishments for the crimes proven by the high court vigilance are needed.
