
PATHANAMTHITTA: The Pathanamthitta Sessions Court has granted bail to Rahul Mamkootathil MLA in the third rape case. The verdict was postponed yesterday after the prosecutor raised doubts about the authenticity of the digital evidence.
The defense argued that the sexual intercourse with the complainant was consensual. Rahul's lawyer argued that the arrest was against the Supreme Court's procedures, that the second complaint against Rahul had a political motive, and that the SIT had not been able to move forward in the case. Rahul has been in jail for more than two weeks. With this, Rahul will be released from jail.
The Thiruvalla Magistrate Court had earlier rejected Rahul's bail plea in the third rape case. Justice Arundhati Dilip ordered the bail plea. The verdict was given after two hours of detailed arguments in a closed courtroom. M G Devi appeared for the prosecution. The defense presented digital evidence, including evidence, that Rahul had a consensual relationship with the woman. However, the prosecution's argument was accepted and bail was denied. The prosecution told the court that the accused is a habitual offender and more complaints are coming against Rahul.
Meantime, the high court will consider again the anticipatory bail plea in the first rape case against Rahul today. A bench of Justice Kausar Edappagath is hearing the arguments of Rahul's plea. The prosecution had filed a report opposing his anticipatory bail plea.
