Use of state emblem: New guidelines face criticism over errors

THIRUVANANTHAPURAM: A new government order issued to remove confusion over the use of the state emblem has drawn criticism for containing serious errors. The General Administration (Protocol) Department issued the order on March 13th, describing it as a set of guidelines to regulate the use of the official emblem and prevent its misuse.

One major lapse pointed out is that the Advocate General, a constitutional authority, has not been included in the list of those permitted to use the emblem. As per the order, if the Advocate General uses the state emblem, it could be treated as illegal. Earlier, the Advocate General was allowed to use the emblem. Another issue is the instruction that the state emblem should be displayed in the High Court. In practice, High Courts are required to display the national emblem of India, not the state emblem.

The order also bars KAS officers from using the state emblem on official orders or letterheads. It further states that no individual can use the state emblem or any similar symbol without prior permission from the state government.

Where the official emblem can be used

  1. The Governor, Chief Minister, Speaker, State Ministers, Leader of the Opposition, Deputy Speaker, Government Chief Whip, and individuals with cabinet rank.
  2. Offices in Kerala Lok Bhavan and the Kerala Legislative Assembly, and their gazetted officers.
  3. Planning Board office and its gazetted officers (if no separate emblem is adopted).
  4. Chief Electoral Officer, the office, and its gazetted officers.
  5. Kerala Public Service Commission (if no separate emblem is adopted).
  6. Commissions and statutory authorities formed by an Act passed by the Assembly or established by the state government.
