'Further investigation is still possible in actress attack case, senior lawyers will attend it at High Court'

KOCHI: The actress attack case has more importance than just a criminal case, says TB Mini, the victim's lawyer. She added that there were no lawyers to take up the case and that the evidence was questionable until the verdict was released. She believes that this case is not just about individual lawyers. It is about the society. TB Mini also stated in a Facebook post that senior lawyers will be brought in to handle the case in the High Court.

The actress attack case has significance beyond being a criminal case. The fact that there were no lawyers to take up this case and that it was in camera was a source of doubt until the judgment came out.

CrPC or BNSS does not give any scope to the victim for any intervention in the trial court. Moreover, if the victim's lawyer does not have a good relationship with the prosecution and does not work in the same legal frame, the accused will escape because of it. Contradiction is always the reason for the accused to escape.

So now the judgment has come out. Many lawyers are saying many things about the prosecution, both in favour and against. In any criminal case, the court should say that the prosecution could not prove the case beyond reasonable doubt to let the accused walk free. It is enough for the accused to create doubt. The prosecution must prove it beyond reasonable doubt. Whereas conspiracy is not like that, there are stages that the accused must prove.

At the beginning, I felt that my fellow lawyers were afraid to even speak up if they saw me, to take up this case or cooperate with the case. Today, the picture has changed. Many lawyers have read this judgment. They are also aware of the evidence. Constructive criticism, legal errors and omissions can be sent to me personally with the idea that justice should be given to the victim. The victim's lawyer can present the case in a good manner in the High Court. We will bring a good senior criminal lawyer from India. We will assist them and the prosecution as a team without contradiction. Research is important in this.
