State Commissionerate for Persons with Disabilities files case against PSC for denying job due to 1 min delay

KOCHI: The Kerala State Commissionerate for Persons with Disabilities has voluntarily filed a case against the PSC based on a Kerala Kaumudi report that Saiju (49), a visually-impaired man was denied job as he was 1 minute late.

The PSC Secretary is the first party and Ernakulam District PSC Officer is the second party in the case. State Commissioner for Persons with Disabilities Justice SH Panchapakesan has said that details and documents have been collected from Saiju.

Justice Panchapakesan said that our legal system says that differently-abled people should be accommodated and the action of PSC is against the law and the system. The case is under the Rights of Persons with Disabilities Act, 2016.

PSC denied the job to Saiju on the grounds that the appointment recommendation was delayed by one minute even though the person who is ahead of him in the supplementary rank list said he did not want the job. The appointment recommendation which was supposed to arrive before 12 am on March 31, 2018 was received at 12:01 am.

The PSC also rejected the administrative tribunal's ruling that the appointment should be made if there is a vacancy. Saiju is about to approach the High Court. He has expressed gratitude as the Commissioner has intervened in the issue.
