Expert committee suggests increasing court fee by five times

THIRUVANANTHAPURAM: The expert committee, chaired by retired Justice VK Mohanan, recommended increasing court fees in the state by up to five times. The report said the central government was not paying the proper amount for the workings of the courts, and in such a situation, a fee reform seemed necessary.

The report was handed over to Law Minister P. Rajeev on Thursday. The court fee was last revised in 2003. Over the years, the government has been battered by heavy financial burdens from the courts. The state government is spending ten times the revenue received from judicial institutions for running the courts. Rs 125.6 crore was received from judicial institutions in 2023. However, in the same year, the government had to spend Rs 1248.75 crores to properly run courts.

No fixed fee was imposed on petitions and anticipatory bail applications like settlement cases, or compensation cases related to land acquisition. The report says that a fee should be introduced for this too. The report was prepared based on suggestions received from advocates and advocate organizations. The report was prepared based on the judgments of the Supreme Court and others and the recommendations of the 189th report of the commission.

Committee Chairman Rt. Justice V.K. Mohanan handed over the report to the minister. The other members of the committee are Law Secretary KG Sanalkumar, Finance Additional Chief Secretary Dr. A. Jayathilak, Dr. N.K. Jayakumar, and CP Pramod.
