"When Kemal Pasha was a judge in Thiruvananthapuram, I appeared in his court on behalf of my senior. During that period, he pronounced the death penalty in three cases. One of them was the death sentence of an accused named Kaala Murugan. I was present in the court that day. It was a case where Kaala Murugan had stabbed and killed a police officer.
The accused was someone who usually carried a knife and was involved in several prior incidents of stabbing people in their hands or legs. However, in this case, he stabbed the police officer in the chest while resisting arrest. The chest injury near the heart led to the officer's death. Kemal Pasha sentenced Murugan to death, citing it as one of the 'rarest of rare cases.'
Another case involved the murder of a person who died due to head injuries caused by a bomb thrown as part of gang rivalries. The accused in that case also received the death penalty from Pasha. There are many such cases.
According to Kemal Pasha, all the cases in which he delivered death sentences fell into the rarest of rare categories. How can a retired High Court judge say that the rest of the cases do not fall under this category? Such statements undermine the morality of the judiciary and its officers. While there is freedom to criticize court verdicts, it also matters who makes these criticisms, when, and how," said Advocate Vineeth.
