Actress assault case; High Court rejects Dileep's appeal, affirms survivor's right to investigation report

KOCHI: The High Court rejected Dileep's appeal, which sought to prevent the investigation report in the case of assault on the actress from being given to the survivor. The appeal was dismissed by the Division Bench of the High Court. Dileep filed an appeal yesterday challenging the single bench order to provide a copy of the witness statement in the fact-finding report prepared by the district judge to the survivor. The appeal was heard by a division bench comprising Justices M Nagaresh and PM Manoj. Dileep argued in court that entertaining new demands in the settled petition would violate the Supreme Court verdict.

Dileep also informed the court that the single bench did not acknowledge his objection to the order to provide the transcript to the survivor. However, the survivor countered in court, stating that she had approached the High Court because her fundamental rights had been violated. She also asserted that as a petitioner, she has the right to know the statements in the fact-finding report.

A fact-finding report was submitted by the district judge, confirming the survivor's allegation that the memory card, a crucial piece of evidence in the assault case on the actress was illegally accessed. According to the report, Adimali Magistrate Leena Rasheed, District Judge's PA Mahesh and Trial Court Shirastadaar Tajuddin examined the memory card.
