62-year-old woman granted court permission to have dead husband’s sperm extracted

SYDNEY: The court ruled that 62-year-old woman who lost her husband can still become a mother, after a legal battle. The woman has got the opportunity to give birth to a child through surrogacy by extracting her husband's sperm. Her husband died on December 17 due to old age-related ailments. However, 62-year-old approached the hospital with the request to conceive a baby through her husband's sperm.


She requested the authorities to extract her husband's sperm. However, the hospital authorities informed that they will not extract the sperm without the permission of the court. Experts said that sperm should be collected from the dead within two days. She then approached the court in Western Australia for permission.


The court ordered to extract the sperm and store it. However, the court directed that special permission of the court is required for surrogacy. The adverse judgment was passed on the plea filed by the 62-year-old regarding pregnancy on December 22.


The couple's 31-year-old son died in a car accident in 2019. Her 29-year-old daughter died in a boat accident later. It was after this that the couple decided to have a third child. The 62-year-old told the media that a third child was her husband's wish and she approached the court for that.


This is not the first incident in Australia. A similar incident happened in last June also. The court gave special permission to the wife to collect the sperm of her 29-year-old husband, who died in the accident and conceive a baby.
