"Welfare of citizens must be prioritized...": Centre on Rohingya right to stay in India

NEW DELHI: The Centre, in an affidavit filed at the Supreme Court, said that India has to prioritize its citizens as the world's most populous developing country with limited resources. The affidavit said that unchecked immigration and Rohingya refugees pose serious implications for national security.

The central government clarified its position while considering the petition submitted for the release of the Rohingya refugees who are being detained on the charge of violating the Foreigners Act.

"A foreigner only enjoys the right to life and liberty under Article 21 and cannot claim a fundamental right to reside or settle in India. That right is available only to Indian citizens," the Centre said.

"Since India is not a signatory to the 1951 Refugee Convention and its Protocol relating to the Status of Refugees, it would handle the issue of Rohingyas based on its own domestic framework," the Union government's Ministry of Home Affairs said.
