KOCHI: The Kerala High Court annulled the government's action of appointing a judicial commission on the Munambam land issue. The action was after accepting the plea filed by the Waqf Protection Forum, questioning the validity of the appointment of the commission. The plea was considered by a single bench led by Justice Bechu Kurian Thomas. The government will appeal against the action.
The court inquired whether the Waqf Protection Forum has the right to file a petition. They have intervened in the case earlier also. There is a public interest in the case. Therefore, it was clear to the court that the petition was valid and considered it later.
The Munambam land is within the jurisdiction of the Waqf Board and the Waqf Tribunal. The civil court had also found earlier that it is the land of Waqf. The court also examined whether the government has the power and right to appoint a judicial commission in such a situation. The Waqf Board has full authority over Waqf land. They have a precise legal code. The court also found that there is no need for the intervention of an external force in this situation.
