Rape case will remain, no lapse in investigation; big setback for MLA Rahul Mamkootathil, copy of court verdict out

PATHANAMTHITTA: A copy of the court verdict denying bail to MLA Rahul Mamkootathil in the third sexual assault case has been released. Rahul's bail was denied by the Thiruvalla Magistrate's Court. The order was passed by Justice Arundhati Dileep. The court denied bail after rejecting all of Rahul's arguments.

The court said that the complaint is serious, that the accused has committed similar crimes in the past, and that there is a possibility that the accused will influence and threaten the victim if he gets bail. The judgment copy also pointed out that there is a possibility of crucial evidence in the case being destroyed.

The court has clarified that the sexual intercourse was not consensual, that the crime of rape exists, and that the prosecution's argument of cyber attack is serious. The prosecution pointed out that there is a cyber attack that reveals the privacy of the victim. The court also rejected the argument that the complainant's statement did not have a signature. The court clarified that a digital signature is sufficient and that there was no lapse in the procedures.

The Thiruvalla Magistrate's Court also clarified that the complainant had sent an email directly to the court to ensure the credibility of the statement. The court pointed out that in cases of a serious nature, an online statement and digital signature would be sufficient. The court clarified that the arrest was legal and there was no lapse in the investigation procedures.
