
KASARGOD: A case will be registered against a BJP leader for filing a complaint seeking to remove the name of Mohammed of Paivalike from the voters list on the grounds that he does not have an Indian citizenship. Legal action will be taken against BJP district secretary Lokesh Londa, who filed a complaint under Form-7 seeking the removal of his name from the voters list of Manjeswaram assembly constituency.
A legal hearing was held on February 13. Although the complainant appeared for the hearing, he could not submit any documentary evidence to prove his allegations. Based on the examination of documents and collection of information during the hearing, the complaint filed was found to be false and baseless, said Collector K Imbashekhar.
The election registration officer therefore ordered to retain his name in the present voters list. On examination, it was found that the complaint submitted was intentionally filed with false information, and therefore, it will be considered a punishable offence under Section 31 of the Representation of the People Act, 1950. Accordingly, an FIR will be registered against the person concerned and legal action will be taken.
If found guilty, the punishment can be imprisonment for up to one year, fine, or both. While it is a legal right to file an objection under Form-7 to ensure the accuracy of the voter list, attempts to mislead the democratic process by providing false information with malicious intent will be subject to strict legal action. District Collector K Imbashekhar, who is also the district election officer, requested everyone to behave responsibly and cooperate in the legal process as baseless and false complaints create confusion among the public.
