Investigation and trial of Sharon murder case can be conducted in Kerala, no legal issues

THIRUVANANTHAPURAM: The further proceedings in Parassala Sharon murder case need not be handed over to the Tamil Nadu police. The charge sheet submission and trial can be conducted in Kerala. The concoction was given at Greeshma's home in Ramavarmanchira, Tamil Nadu. Hence the move was to hand over the case to the Tamil Nadu police. However, Sharon died at Thiruvananthapuram Medical College hospital and his house is ar Parassala within the Kerala border. Therefore, there is no hindrance in conducting case investigation and trial in Kerala.

Sections 177, 178 and 179 of the Code of Criminal Procedure states that if an offense is committed at several places, the courts at all these places have jurisdiction to investigate and conduct trial. The trial can be held anywhere. Legal experts point out that since Sharon died in Thiruvananthapuram, the charge sheet can be filed and the trial can be conducted in the court here. Sharon's family had also come forward against handing over the case investigation to the Tamil Nadu Police. The family is worried that the Tamil Nadu police may sabotage the investigation.

The Tamil Nadu Police provided protection to the accused Greeshma's mother and uncle when the Thiruvananthapuram Rural Crime Branch brought them to their house in Ramavarmanchira for evidence collection. They helped in finding the poison bottle and identifying the shop where the potion was bought from. Police chief Anil Kant had sought legal advice as there was concern that the case would be weakened at the trial stage if the investigation was not handed over to the Tamil Nadu police. The government has also decided to file the case in Kerala.
