
THIRUVANANTHAPURAM: The Kerala government has decided to strictly implement the Central Motor Vehicle Act amendment, which includes cancellation of the license of a person if he commits five or moretraffic rule violations in a year. The Central government amended the law on the 21st with the aim of reducing road accidents. The state Motor Vehicle Department has decided to implement them as is.
The provisions include blacklisting a vehicle that repeatedly violates the law and taking it into custody by the Motor Vehicles Department with the permission of the court. Kerala Kaumudi published a report on this.
The amendment came into effect from January 1. The main provision is that if a person receives five or more challans in a year, their driving license will be suspended. The fine must be paid within 45 days of receiving a challan. Vehicles with outstanding challans can be seized by the department officials until they are paid.
Blacklisted if fines are due
Vehicles with fines due will be blacklisted. Except for tax payment, no other services will be allowed for that vehicle on the Parivahan site. Services like change of address, change of ownership, change of vehicle class, permit, fitness, cancellation of hypothecation etc. will also not be available.
Legal action will be taken against the RC owner of the vehicle that violated the law. If someone else was driving, the onus of proof lies with the vehicle owner.
If a person wants to question the challan, he must approach the court himself. The onus of proving that he did not violate the law will be on the person concerned.
