KOCHI: The High Court has ruled that the Central Companies Act is applicable to SNDP Yogam. The division bench comprising Justice Devan Ramachandran and Justice MB Snehalatha set aside the single bench order that it is the Kerala Non-Trading Companies Act which applies to Yogam.
The four appeals filed by SNDP Yogam, including by General Secretary Vellappally Natesan, questioned the single bench's order that all members have voting rights by scrapping the provision in the Yogam bye-laws that allows voting by representation in elections. The division bench accepted the arguments of the petitioners. The central government had also informed the court that the Central Companies Act was applicable since it operates outside Kerala as well. Adv. Adv. Elvin Peter and Adv. Santosh Mathew appeared for the SNDP Yogam.
