KOCHI: A person in police custody if brought to a doctor or magistrates should follow the protocols on a war footing. The HC asked the state government to implement the new protocol. The government asked for two more weeks to prepare but the HC rescinded and gave the final deadline on May 25th. The court consisting of Justice Devan Ramachandran and Justice Kauser initiated a suo moto case minding the horrendous murder of duty doctor Vandana Das in Kottarakkara taluk hospital.
The HC doubted the efficiency of the health system if the doctors and staff are reportedly being subjected to attacks and violence. Even after the Vandana Das murder, many such occurrences made headlines in Kerala. One person tried committing suicide in front of a magistrate.HC suggested the government seek opinions from doctors and other health workers before moving with the reforms." How come parents send their daughters and sons to work at night if such is the appalling state of affairs in kerala hospitals" the HC asked
Meanwhile, the government informed the court about preparing an ordinance to find a proper solution to the issue. The HC rebuked saying more than issues concerning individuals, the spotlight should be on the person brought by police to the doctors. The HC also asked the police to be at their vigilant best while bringing the accused to the doctors and magistrates. The government asked for more time to prepare the protocol, while the HC retorted by asking for assurance from the government that no such attacks will happen during the time taken for preparation.
The lawyer who appeared for health university said the move to bring police aid posts near hospitals was futile. The police aid post will be constructed near one corner of the acre covering the hospital. If any attacks happen to duty doctors or staff, the police can only react late which fails the purpose.
