Blow for Dileep in actor assault case; HC orders to hand over investigation report to survivor

KOCHI: The Kerala High Court ordered to hand over the investigation report on the leak of the memory card in the actor assault case. The order is that of Justice K Babu. The high court directed the principal sessions judge to hand over the copy of the report to the actress.

The actress had approached the high court questioning the non-receipt of the report. Actor Dileep, the eighth accused in the case, had opposed this. Dileep demanded that the copy of the report should not be handed over to the survivor instead it should be given to him. The court did not accept his request.

The survivor approached the high court seeking a copy of the investigation report on the complaint that the memory card in custody was illegally examined in the case. The plea argued that despite the trial court having completed the investigation, the findings of the report were not disclosed and a copy was not sent.

The survivor approached the high court after the forensic discovery that the hash value of the memory card with defamatory images was changed while in custody of the trial court. The court then appointed the district sessions judge to investigate the matter. The survivor had earlier sent a letter to the trial court asking to investigate who illegally examined the memory card. The letter demanded that the case should be investigated fairly and the owner of the phone should be found.

The hash value in the memory card was found to have changed during the examination conducted at the Thiruvananthapuram Forensic Lab. The district sessions judge then investigated the incident and submitted a report to the high court. The survivor approached the sessions court requesting a copy of it, but it was informed that the report is confidential and therefore cannot be handed over. Following that, she filed a plea in the high court seeking a copy of the report.
