RoR not mandatory for title deed registration: Kerala HC

KOCHI: The High Court has ruled that it is not mandatory to produce Thandaper Registration Certificate (RoR) and Ownership Certificate to register title deed. Justice Viju Abraham's order was against the action of Cherpu Sub-Registrar, who refused to register the 8.67 sq. m plot of land in Edakuni village, for a person named Rudradas who got it as gift deed from his mother. This is because they said person did not produce two documents. The court also stated that if someone comes claiming the right over the land in the future, the petitioner will be responsible for it.


The land Rudradas received after the death of the mother has title deed and tax payment records. The court pointed out that there is an earlier ruling in similar cases that there is no ambiguity in the existing documents regarding the right and that there is no need to insist on certain matters. Adv RS Manjula appeared for the petitioner.
