'Kejriwal will have final say'; Delhi HC on petition seeking Kejriwal's removal as CM

NEW DELHI: The Delhi High Court on Thursday quashed a petition demanding the resignation of CM Arvind Kejriwal who is currently placed in Tihar jail for the liquor scam. The court remarked that it will be Kejriwal who should decide whether to continue in the office or resign.

The High Court backed off from giving a decision on the matter and asked the Lieutenant Governor of Delhi or the President to inspect whether there exists any chance of an administrative crisis in Delhi.

A division bench comprising acting Chief Justice Manmohan and Justice Manmeet Pritam Singh Arora was hearing a PIL filed by Hindu Sena president Vishnu Gupta.

“How can the court determine whether the government is functioning or not? The Lieutenant Governor has the power to decide the matter. There is no need for the court to intrude. The Lieutenant Governor will do what can be done by law. Is there a case where the court ordered the President's rule or Governor's rule?’ asked HC.

It was added that the petitioner can approach the Lieutenant Governor or the President. With this, the Hindu Sena president withdrew the petition. On March 28, the High Court rejected another petition with similar demands.
