KOCHI: The government filed a sub-plea in the Kerala High Court in connection with the examination of memory card in the actor assault case. The government demanded a circular in safeguarding the digital evidence. The government has also demanded that the guidelines issued by the high court be circulated to the lower courts. A single bench of Justice K Babu of the high court will consider government’s sub-plea today.
The district judge's report upheld the allegation of the survivor that the memory card in the case was examined illegally. The finding was against Angamaly Magistrate Leena Rasheed’s personal assistant Mahesh Mohan and trial court sheristadar Tajudeen.
The investigation report said magistrate Leena Rasheed of Angamaly Court examined the footages of the memory card on January 1 in 2018 at 11.56 pm and her assistant Mahesh at 10.58 pm on December 13 and sheristadar Tajuddin of trial court on July 19, 2021. The report also stated that only Tajuddin's action is illegal.
Meanwhile, the high court rejected the appeal filed by Dileep requesting not to give the investigation report in the actor assault case to the survivor. The appeal was rejected by the division bench of the high court. Dileep filed the appeal questioning the order of the single bench to give the copy of the witness statement in the fact-finding report prepared by the district judge to the survivor. The appeal was considered by a division bench comprising Justices M Nagaresh and P M Manoj. Dileep argued in the court that considering new demands in the settled plea is a violation of the Supreme Court verdict.
