No evidence of prima facie rape; Court says there is contradiction between statement and FIR filed against Rahul Mamkootathil

THIRUVANANTHAPURAM: The court order granting anticipatory bail in the second case against Rahul Mamkootathil states that there is no evidence of prima facie rape. The order of the Thiruvananthapuram Principal Sessions Court points out that there are contradictions in the complaint and the statement given later by the woman. "What is said in the statement is not what is said in the FIR. The argument that there is pressure behind the complaint cannot be rejected. The arguments regarding the delay in filing the complaint are dissimilar," the order says.

Meanwhile, the order adds that the complaint is of a very serious nature. The order states that if Rahul is arrested, he should be released on two sureties of Rs 50,000 each and that he should appear before the investigation team every fortnight on Mondays.

The court granted anticipatory bail to Rahul Mamkootathil with conditions in the case of molestation of a Malayali woman living in Bengaluru. The conditions for granting anticipatory bail have also been specified in the court order. He has been directed to appear before the investigation team every Monday from 10 to 11 am. The order also states that if arrested, he will be granted bail on the same day.

Meanwhile, the prosecution has decided to appeal in the High Court against the court order granting anticipatory bail to Rahul Mamkootathil in the second case. The prosecution will request the High Court to cancel the bail.
