KOCHI: The Kerala High Court on Tuesday ruled that children of inter-faith couples are entitled to alimony from the father and that neither caste nor religion should be the criterion in determining the duty of the father. The division bench, consisting of Justice Mushtaq and Justice Dr A Kauser Edappagath, said that all children should be treated equally irrespective of the caste and religion of the parents.
The division bench was considering the petition filed by Kozhikode native JW Aragathan, a practising Hindu against the order issued by the Nedumangad Family Court. The Family Court had ordered Aragathan to pay Rs 14.67 lakh for marriage expenses to the daughter of his Muslim wife, Rs 96,000 for her education expenses and Rs 1 lakh as alimony.
