THIRUVANANTHAPURAM: The investigation team has decided to cancel the anticipatory bail granted to actor and MLA Mukesh in a sexual harassment case. The Special Investigation Team (SIT) received legal advice from the Director General of Prosecution that an appeal can be filed in the High Court on the issue. THE SIT is of the view that the anticipatory bail granted by the sessions court will affect the further investigation. The appeal will be given by pointing this out. The court will be told that the court's verdict distrusts the complainant and that it is a case that is years old.
Maradu police had registered a case against MLA Mukesh on the complaint of the actress, a native of Ernakulam. A case was registered under sections 354, 509 and 452 of the IPC. The court had observed that there were major contradictions in the statement of the complainant actress. The court had completely rejected the claim of sexual harassment by force and granted anticipatory bail to Mukesh. Mukesh was granted bail by the Ernakulam Sessions Court on the condition that he should not leave Kerala and should cooperate with the investigation.
The investigating team will point out in the appeal that this will affect the further investigation and trial of the case. Mukesh claimed that the complaint of the actress, a native of Aluva, that she was raped was made up. Mukesh had said that there were other motives behind the actress coming up with the complaint after 15 years and that the actress had tried to blackmail him and demanded money from him.
