Kiran's dismissal: Experts say action will not stand

KOLLAM: The Transport Minister had yesterday announced that Kiran Kumar, a motor vehicle inspector, was dismissed from service in connection with the death of his wife Vismaya, a resident of Nilamel. The reasons for Kiran's dismissal were the violation of anti-dowry law for government employees and misogynistic activities.

Many, including Vismaya's relatives, welcomed Kiran's dismissal. On social media, people commented that the punishment was exemplary. But experts say the dismissal action will not stand.

Kiran Kumar can approach the Administrative Tribunal under Article 226 of the Constitution against the dismissal. Remand for more than 48 hours may result in suspension. Legal experts say he can only be a convict if punished by a court, and that dismissal will not stand. The rule to give a charge memo to hear the side of the accused was followed here.
