Wife’s not female, pregnancy impossible; husband approaches SC for divorce

NEW DELHI: A husband has filed a plea in the Supreme Court (SC) seeking divorce on the grounds that his wife is not a female. He has approached the supreme court challenging a Madhya Pradesh High Court (HC) order that rejected his divorce plea. The court which heard the case has sought an explanation from the wife.

‘According to medical reports, my wife is not a female. I feel cheated’, the husband informed the court. The court has asked the wife to reply within four weeks. Meantime, Madhya Pradesh high court has dismissed the man's plea saying that a cheating charge could not be established only on the basis of oral evidence, without any medical evidence.

The couple had got married in 2016. The wife did not consummate the marriage for some days claiming she was menstruating. Later, she went to her house. In the following days, when the man tried to get intimate with his wife, he found that the vaginal opening was absent, said the plea. The petitioner then took his wife for a medical check-up. The diagnosis revealed that his wife had a rare condition of imperforate hymen. The doctors suggested surgery as a remedy.

However, the chances of pregnancy was close to impossible even after the surgery, said the doctors. With that, the man decided to end the marriage. The petition also said that the man’s father-in-law had threatened him and he had to lodge a complaint with the police.
