Virginty test unconstitutional, Sister Sephy can file defamation against CBI: Delhi High Court

NEW DELHI: The Delhi high court has deemed the virginity test unconstitutional and ordered such a test should not be given green light. The court was adjudicating a plea from the convicted nun in the infamous Abhaya case. Justice SK Sharma in the judgment said the virginity test on sister Sephy was unconstitutional and said it should not be conducted in the first place as it is a gross intrusion into the dignity of a citizen. The CBI first conducted the virginity test on convict sister Sephy back in 2009. Sister Sephy then moved a plea against it and the current ruling from the court is on that. No agency can proceed with the virginity test, no matter whether it is a convict or not. The test demeans the privacy and dignity of the person, the court ruled.

The court has opened that Sephy can proceed with defamation and a criminal case against the CBI after the case gets wrapped. The supreme court has earlier asked the central government to stop “two-finger test” among sexual assault victims.
