WASHINGTON: The US Trade Court has come forward against President Donald Trump's action of imposing tariffs on countries including India. The court's assessment is that Trump's move is an abuse of power. It has also blocked the tax imposition. The action is by the Manhattan International Trade Court, a federal court in the US that considers trade issues.
The court clarified that the president does not have the authority to impose taxes on countries without the approval of the US parliament, Congress. The court also demanded that the tax imposition be withdrawn within ten days. Trump imposed taxes on countries under the International Economic Powers Act (IEEPA) of 1977, which allows the US president to take independent action on economic emergencies of national importance.
The court observed that the US has a trade deficit not due to this issue of national importance. Moreover, the court ruled that this law does not give the president unlimited powers. According to the Constitution, only the US parliament, has the authority to impose restrictions on international trade. The court said that the president cannot overturn his power. The court announced its ruling against Trump on a petition filed by the attorneys general of 12 states governed by Democrats.
