NEW DELHI: The Supreme Court on Friday dismissed a plea challenging the decision denying sanction to prosecute Uttar Pradesh Chief Minister Yogi Adityanath in a case of hate speech in 2007. The verdict was delivered by a bench comprising Chief Justice NV Ramana, Justice Hima Kohli and Justice CT Ravikumar.
'We do not think it necessary to go into the legal questions relating to the grant of permission. Consequently, the appeal is dismissed," Justice Ravikumar said while reading the judgment.
The petitioner, Parvez, had alleged that Yogi Adityanath had made anti-Muslim remarks while speaking at a meeting held in Gorakhpur on January 27, 2007. The petitioner also challenged the UP government's decision on May 3, 2017, which denied permission to prosecute Yogi.
The lawyer appearing for the petitioner said that it was proved that Yogi Adityanath had given hate speech. The counter argument was that the CD with the recording of the hate speech is a fake.
