KOCHI: The GST Council has informed the High Court that petroleum products cannot be included in the GST. Petroleum products are the main source of revenue for the government.
The GST Council told the High Court that the matter could not be considered now as it is pandemic time and further consultation is needed. Dissatisfied with the reply, the High Court asked the GST Council to give an accurate explanation. The petition will be considered again in the second week of December.
A division bench of Chief Justice S Mani Kumar and Justice Shaji P Chali is considering a petition filed by Kerala Pradesh Gandhi Darshan Vedi seeking inclusion of petrol and diesel in the GST. The High Court had directed the Central Government and the GST Council to take a stand on the rejection of the demand for inclusion of petrol and diesel in the GST.
The court had earlier directed to send the petitioners' petition seeking inclusion of petrol and diesel in the GST to the Central Government and take a decision. The petitioners approached the High Court again after the GST Council rejected the petition, alleging that the petition was rejected without giving sufficient reason.
