Serious cases like POCSO cannot be dismissed based on compromise: High court lifts stay on trial

KOCHI: The High Court has said that serious cases like POCSO cannot be dismissed based on a compromise between the accused and the victim. Justice A Badaruddin's order rejected the petition filed by Kozhikode native Dr PV Narayanan seeking dismissal of the case alleging that the girl's private parts were touched during the body examination.

A Plus One student who had come to the clinic for treatment in July 2016 filed a complaint with the Nallalam police. The argument was that the body examination was carried out in the presence of a neighbour woman and her daughter. The body examination was carried out because the child had complained of stomach pain. It was also argued that the girl had given an affidavit in 2024 in favour of withdrawing the case. Rejecting this, the court lifted the stay on the trial and ordered that the case be completed as soon as possible.
