KOCHI: The Kerala High Court rejected the sub-plea filed by the survivor against examining the memory card, the evidence in the actor assault case. The survivor’s demand was that the fact-finding report of the Ernakulam Principal Sections Judge should be quashed and a re-investigation should be conducted under the supervision of the high court. This has been rejected by the high court.
Justice C S Dias dismissed the plea pointing that the plea is not legally maintainable. The court also informed that she can approach the high court with another plea if she wants. The inquiry report was submitted to the high court by the principal sessions judge.
The high court had earlier announced an inquiry into the complaint of the survivor that the information on the memory card, which recorded the scenes of the attack on the actress, had been leaked. The district principal sessions judge then submitted a report that the memory card was examined thrice and its hash value had changed.
However, the survivor approached the court again stating that the investigation was conducted without even contacting her and many things that should have been considered factually were not investigated. The court had earlier ordered to give the copy of the investigation report and the statement included in it to the survivor.
