NEW DELHI: KSEB should allow electricity to a building, only if the old owner or the new one pays the existing arrears. CJI D Y Chandracud, Justice Hima Kohli, and Justice P S Narasimha constituted-bench dismissed a petition against KSEB while considering the case. According to KSEB, no new connections will be allowed if there exist pending arrears within a building. The same stands for existing electricity connections for any building, as the KSEB will have to disconnect electricity from such buildings failing to pay electricity tariffs.
The high court earlier favored KSEB while considering the case. Now, the supreme court too lined up with the KSEB view, dismissing the petition against the board. If a house is sold at auction, the new owner is liable to pay all the dues existing in electricity to continue enjoying service. The SC also pointed governments to do the necessary inclusion of the same in the agreement papers.
