New CJM appointee not taken up post yet; will delay the considering of CBI report giving clean chit to Solar accused

THIRUVANANTHAPURAM: The Thiruvananthapuram Chief Judicial Magistrate (CJM) court will delay in considering the CBI report that gives clean chit to Solar rape case accused including Oommen Chandy and AP Abdullakutty.

The reason for the delay is that the new CJM, K Vidyadharan, who was transferred by the High Court from Legal Services Authority Secretary has not taken up the post yet.

As Legal Services Authority is a deputation post, the CM’s sign is required to be relived from that post. The Chief Minister, who was out of the state, will reach the capital today. Tomorrow he will go for the inauguration of the Indian Library Congress at Kannur and the Kozhikode State School Cultural Fest. He will be able to sign the file only next Wednesday. Then only K Vidyadharan can officially begin his job as CJM.

The CBI report was received by the charge Magistrate. However, it is the CJM who should consider the report and give notice to the complainant.

The complainant can file a plea demanding the rejection of the CBI report and to accept the evidences given by her. The CJM can directly take evidences in it, the statements can be taken, and if there is strength to the evidences, the CJM can reject the report and order more investigation. Or the court can investigate it directly and then order another investigation.

The CBI had given clean chit to Oommen Chandy, KC Venugopal, Hibi Eden, Adoor Prakash, AP Anil Kumar, AP Abdullakutty, and Thomas Kuruvilla.
