KOCHI: Department Secretary K Biju has tendered a fresh apology in the Kerala High Court over the controversial prosecution sanction order in the cashew corporation corruption case. The new order was issued after carefully examining the legal and factual matters. He also clarified in the new affidavit that the action was taken based on the conviction that a prima facie case existed.
K Biju filed a fresh apology following severe criticism from the court. K Biju's first order had stated that permission to prosecute the accused was being given due to pressure from the court. The high court had harshly criticized the first apology filed against this. The court had harshly criticized whether the department secretary who issued the order was signing an order prepared by the accused.
The court had also given a stern warning that no government can protect its officials if remarks are passed against the court. The court asked how is he still in service. The court had stated that the officer committed an extremely serious mistake and that no leniency of any kind would be shown towards him.
