NEET protest: States can withdraw FIRs against students in accordance with law, says Supreme Court

NEW DELHI: The Supreme Court on Monday said states are free to decide whether to withdraw FIRs registered against students who took part in protests over alleged irregularities in the NEET-UG examination. The observation came while the court was hearing petitions related to the students' protest held at Jantar Mantar in New Delhi on July 20.

A Bench headed by Chief Justice Surya Kant said states have the discretion to withdraw criminal cases against student protesters wherever it is legally permissible. The court directed the states to first classify the FIRs registered across the country and then take appropriate legal action in each case.

The Bench also observed that the term "criminal background" should apply only to those involved in serious offences such as murder, rape and terrorism. During the hearing, the Supreme Court also indicated that it may consider setting up a high-level committee to examine issues arising out of student protests.

The Bench further said it intends to frame a comprehensive protocol governing the use of pellet guns by law enforcement agencies. It observed that the court would decide whether pellet guns should be used and, if so, under what circumstances. The matter has been posted for further hearing on August 18.
